  1. GENERAL NOTES AND DEFINITIONS

    1.1. This website, including all information, tools and services available from this site to you, the user, is conditioned upon your acceptance of all terms, conditions, policies and notices stated here. Please review these carefully and contact us with any questions before booking. Your participation in the retreat signifies your acceptance of these terms and conditions.

    1.2. Definitions: The term retreat refers to the Pilates retreat organised by Skill to Flow (onosto vof | KvK 85389447) as described in this document. The term participants refers to any individuals who have made a reservation, paid the required fees, and actively participate in the retreat. The terms organisers and we, us, and our refer to the entity responsible for organising and conducting the retreat. The terms you and your refer to the participant, as well as anyone acting on the participant's behalf or with the participant's authority. The term deposit refers to the non-refundable initial payment required to secure a reservation for the retreat. The term retreat start date refers to the specific date when the retreat commences, as indicated on the Skill to Flow website or any official retreat-related communication.

    1.3. We reserve the right to update, amend or replace any part of these terms and conditions at any time without prior notice.

  2. BOOKING AND PAYMENT

    2.1. Pricing and discounts: All prices quoted are per person and include the services specified on the website. All other expenses related to the retreat, such as travel costs and insurance, are not covered and must be taken care of separately by participants. If a discount applies, the reduced rate is valid until the specified date or participant limit is reached. After this point, standard rates apply without exceptions.

    2.2. Reservation and payment: To secure your place at the Pilates retreat, a non-refundable deposit of 30% of the total price for the retreat is required. The outstanding balance must be settled no later than 60 days before the retreat's start date. Failure to meet this payment deadline will lead to reservation cancellation and forfeiture of the deposit.

    2.3. Roommate assignments: Retreat rates are per person, and shared rooms are designed for double occupancy at the specified rate. If you choose to reserve a shared room without designating a roommate, we will make every effort to pair you with your preferred room type and price range. In the event that we are unable to find a suitable roommate for your initial selection, we will offer alternative rooming options. However, please be aware that you may be required to to cover the entire cost of a single room if no compatible roommate is available.

  3. CHANGES AND CANCELLATION

    3.1. Schedule changes: We retain the right to modify the retreat itinerary at anytime, including activities and schedules, or if unforeseen circumstances arise. Every effort will be made to provide equivalent or improved activities in such cases.

    3.2. Cancellation by participants: In case you need to cancel your reservation, please inform us in writing. It's important to note that your deposit is non-refundable. However, if you have already paid the remaining balance at the time of booking, we will provide a full refund of that remaining balance if the cancellation is made at least 60 days prior to the retreat start date. If the cancellation falls between 31-60 days before the retreat start date, a 50% refund of the retreat cost will be issued. Unfortunately, no refunds will be available for cancellations made within 30 days of the retreat start date.

    3.3. Cancellation by the organisers: We retain the right to cancel the retreat at anytime and without prior notice if unforeseen circumstances arise. In such situations, you will receive a full refund of the retreat fees, which includes the deposit. However, it's essential to understand that any additional expenses you may have incurred, such as travel costs, are not within the responsibility of the organisers.

    3.4. Force Majeure: We recognize that unforeseen events, sometimes referred to as Force Majeure Events, can occur beyond anyone's control. Such events may include acts of God, governmental actions, natural disasters, or other circumstances that could not have been anticipated. In cases where a Force Majeure Event prevents either party from fulfilling their obligations under these Terms & Conditions, the affected party will not be held responsible for any delays or failures in performance. In such situations, the party affected by the Force Majeure Event will promptly communicate in writing to the other party, providing details about the event and how it might impact the Terms & Conditions. The affected party will make all reasonable efforts to mitigate the impact of the Force Majeure Event and resume their obligations as soon as possible. During the time the Force Majeure Event continues to affect the situation, the obligations of the affected party will be temporarily suspended, and a reasonable extension of time will be granted to fulfil those obligations.

  4. RETREAT GUIDELINES AND PARTICIPANT RESPONSIBILITIES

    4.1. Travel insurance requirement: All participants are required to have comprehensive travel insurance, which includes coverage for trip cancellation, medical emergencies, and personal liability. Prior to the start of the retreat, you may be asked to provide proof of your insurance coverage. This requirement is in place to safeguard your well-being during the retreat and to ensure you are adequately prepared for any unexpected situations that may arise.

    4.2. Participant responsibility: Please be aware that you are responsible for your own equipment and personal belongings throughout the retreat. We shall not be held responsible for any loss, theft, or damage to your personal property.

    4.3. Respect and courtesy: We expect all participants to treat fellow participants, the organisers, staff and local communities with respect and courtesy. Inappropriate behavior or harassment of any form will not be tolerated and may lead to eviction from the retreat without a refund.

    4.4. Health assessment: As part of the booking process, participants are required to disclose any pre-existing medical conditions, injuries, allergies, or dietary restrictions. This information is essential for us to provide suitable accommodations and ensure your safety during the retreat.

    4.5. Fitness level and medical care: Please be aware that the intensity of Pilates classes may vary. It is your responsibility to evaluate whether you possess the physical and mental capability to participate in the classes and all other retreat activities. If you have any concerns, we strongly recommend consulting with a healthcare professional. By booking this retreat, you acknowledge and release us from any liability, claims, or causes of action arising from the provision or omission of first aid, treatment, or services during your participation in the retreat.

    4.6. Compliance with hygiene measures: We request all participants to adhere to good hygiene practices and follow any preventive hygiene measures in accordance with official public health safety guidelines and current international travel recommendations. It is the responsibility of each participant to take necessary precautions before traveling to the retreat location, including adherence to COVID-19 testing and vaccination protocols, if applicable. We are dedicated to ensuring a safe and comfortable travel experience for all guests and trust that participants will respect these guidelines while maintaining their personal hygiene.

  5. RISK AND LIABILITY

    5.1. Assumption of risk: You acknowledge the presence of risks associated with physical training, including the inherent risks in all Pilates exercise activities. Participation in such physical training programs exposes you to potential hazards, including the risk of injury, property damage, or, in extreme cases, fatality. These risks may include, but are not limited to, the possibility of falls resulting in serious harm or fatality, injury or death due to negligence, improper equipment usage, or equipment failure, as well as strains, sprains, and various dangers associated with factors such as terrain, facilities, weather conditions, equipment, vehicular traffic, and the actions of individuals including participants, volunteers, spectators, coaches, trainers, and even the risk of dehydration. These risks are inherent in physical training and apply to volunteers and spectators as well. You voluntarily assume full responsibility for these risks, accepting complete liability for any potential injury or fatality that may arise from your participation, volunteering, or observation of any physical training activities, including this Pilates retreat. You confirm your awareness that liability may result from negligence, carelessness, dangerous or defective equipment or property ownership, maintenance, or control, as well as possible liability without fault. You further affirm that you do not possess any physical impairments, injuries, or illnesses that would jeopardise your own or others' safety.

    5.2. Release of liability: By participating in the activities of the retreat, you acknowledge that you do so willingly, having assumed all inherent risks. In exchange for your permission to participate, you hereby release any and all liability claims, demands, actions, or rights of action connected to your participation. These may include those allegedly stemming from the negligent acts or omissions of the individuals or entities mentioned above, such as the organisers, their principals, teachers, agents, employees, and volunteers. This agreement is legally binding upon you, your successors, representatives, heirs, executors, assigns, or transferees. If any portion of this agreement is found to be invalid, you agree that the remainder of the agreement shall remain in full legal force and effect.

    5.3. Indemnification: You acknowledge the presence of risk in the activities offered and therefore accept financial responsibility for any injury or damage you may cause, whether to yourself or to any other participant. Should the aforementioned parties, or individuals acting on their behalf, incur attorney's fees and costs to enforce this agreement, you agree to reimburse them for such fees and costs. Furthermore, you consent to indemnify and safeguard the organizers and the hosting organisation, as well as their principals, agents, employees, and volunteers, against any liability resulting from injury or fatality to any person(s) or property damage resulting from your negligent, or intentional actions, or omissions while participating in the retreat.

    5.4 Media release: By participating in our retreat, you grant us the right to use, reuse, and publish your media in whole or in part, alone or with other materials, on current or future publishing platforms, including the Internet, for lawful purposes. This includes but is not limited to illustrations, promotional materials, artwork, editorial content, advertising, and trade-related content. You provide this permission without restrictions on altering photos, videos, written or verbal testimonials, or any other means of capturing your likeness during the retreat. By doing so, you release us from any claims or demands, including those related to libel or invasion of privacy.

  6. AGREEMENT AND WAIVER

    6.1. By participating in our retreat, you agree to the following:

    • You will not make any claims, file lawsuits, or attempt to seize the property of the organizers, their affiliates, teachers, employees, agents, or volunteers for any injury or damage resulting from your participation in the retreat.

    • You confirm your physical, emotional, and overall fitness for the retreat. You take full responsibility for your physical well-being during the retreat and will adhere to safety precautions and instructions provided by the organizers and teachers. You also acknowledge that you are financially responsible for any expenses related to your well-being during the retreat.

    • While the teachers and organizers may offer guidance for your well-being, you acknowledge that they are not licensed medical providers, and you must consult your doctor for medical advice.

    • If you experience discomfort during the retreat, you will adjust the instructions to suit your needs. The organizers are not liable for any pain or discomfort you may experience during or after the retreat. You understand that the retreat activities are not a substitute for medical care and that the organizers are not qualified to perform medical procedures or provide medical diagnoses or treatments.

    6.2. By agreeing to the terms and conditions outlined here, you hereby release and discharge your rights and claims for damages or liabilities that may occur as a result of participation in the retreat.

    6.3 By booking and making a deposit, you acknowledge that you have read, understood, and agreed to the terms and conditions.
